but_1  Hire of property (contracts for leasehold or rent)

A contract for hire or a lease agreement is an important document that specifies the terms of your rental/ lease arrangement. Whether it's called lease, hire or rent in the contract, the legal agreement by which money is paid in order to use land, land and house or a condominium for an agreed period of time in Thailand is governed by the section 'Hire of Property' in the Civil and Commercial Code. In the Civil and Commercial Code the fundamental principles of hire of property in Thailand are;
  1. the property hired can only be sublet or assigned to another person if this is agreed in the hire of property contract;
  2. a hire of property with a period over 3 years must be registered on the title deed at the local land office;
  3. only a written agreement for hire is enforceable by action;
  4. the total registered term for hire of property cannot not exceed 30-years.
Foreigners are not permitted to own land freehold but foreigners can obtain an interest in land through a registered ground or land lease. Before you decide to enter into a long term ground lease you must exercise proper care and planning. We can help and advice in detail on lease structures. Contracts for land leasehold as an alternative for freehold ownership often aim to go beyond the normal laws governing hire of property in the Civil and Commercial Code. These contracts generally include prepaid additional 30-year hire periods and the option in the contract (or addendum to the contract) to transfer the land to a freehold title without further payment. One  essential part of such land leasehold purchase is freehold ownership over the building upon the land. A mortgage is a contract whereby a person, called the mortgagor, assigns a property to another person, called the mortgagee, as security for the performance of an obligation, without delivering the property to the mortgagee. The mortgagee is entitled to be paid out of the mortgaged property in preference to ordinary creditors regardless as to whether or not the ownership of the property has been transferred to a third person.
A loan is a sum of money which is borrowed and has to be paid back, usually together with an additional amount of money that you have to pay as a charge for borrowing. The loan is specified in a loan agreement. Loans and mortgages are often associated with real estate property, whereby the mortgage is registered with the real estate property as security for the lender.

We offer high quality construction contracts for building a house in Thailand in Thai and English. Our construction contracts contain the required terms and conditions (commencement and completion of the work, extension of time for completion, defects and defect liabilities, warranties, breach and termination, indemnities, disputes and arbitration, payment schedules, etc.), specifies the duties and responsibilities of the builder and offers sufficient protection in the event the builder is in default. In case of construction of a building upon leasehold land by the hirer the right of supeficies legally separates the ownership of buildings and land. Deed of Assignment allows one party (the assignor) to legally transfer rights or property they own to someone else (the assignee), either as a gift or in return for a specified amount. The deed of assignment is the legal document or contract stipulating what kind of rights or property has been assigned. The assignor could for example assign his full rights under a sale and purchase agreement (prior to the title transfer) or his leasehold rights under a contract for lease to the assignee.
